CONSTITUTION

Article I
Name and Incorporation
______________________

1.             This Association shall be known as the Marshall County Sportsmen’s Club.

2.             This Club shall be incorporated in its name, as a corporation not for profit under the laws of the State of Illinois.

Article II
Objectives
__________

1.             The objectives of this Association are:
A.    To assure the continued growth of wildlife.
B.    To improve the habitat of wildlife.
C.    To provide recreational facilities for its members.

 

Article III
Section 1
Membership
____________

1.             Membership shall be limited to two hundred (200) members.  Membership is open to anyone 18 years and older.

2.             A membership shall include Club privileges for the member’s spouse, dependent children under 21 years of age, grandchildren under 16 years of age, or significant other.  However handicapped children over 21 years of age shall continue to have Club privileges provided they are accompanied by and under the supervision of one of their parents.
A.    Any guest of a member must be accompanied while on Club premises by a member or member spouse.
B.    Any violation shall subject the member who has given their card or key to a non member to a two hundred fifty dollar ($250.00) fine and/or suspension.

3.             Certificates of membership are not transferable except by the consent of the Board of Directors.  Such transfers are not effective until recorded on the books of association.  Memberships are transferable to immediate family; Mother, father, husband, wife daughter, son, grandparent, and grandchildren.

4.             An initial fee for membership will be two hundred seventy five dollars ($275.00).  There will be dues of one hundred dollars ($100.00) charged per member per year, with any added assessments incurred.  Officers and Directors will be given dues for the time they serve.     Amended 11/3/2013

5.             There will be a gate on the north end of the property.  When a member pays his/her/ dues, he/she will receive a card to this gate.  An extra card may be purchased for five dollars ($5.00).

6.             Dues and added assessments must be paid by the thirty-first (31st) day of January each year.  After January thirty-first (31st), all membership rights will be forfeited if dues and added assessments are not paid.

7.             Members who fail to keep their dues current will be dropped from the roll.  They will not be reinstated until a new membership is obtained.  All fees from past membership must be paid in full before a new membership will be granted.

8.             If member chooses to withdraw from the membership, he/she should notify the Board of Directors by January thirty-first (31st) of the year he/she would like to withdraw.  Notification after January thirty-first (31st) shall subject the member to an additional years dues and assessments.  All keys must be returned to the club.

9.             Memberships pre December 31, 1995 upon withdrawing from the Club shall be reimbursed $185.00.

10.           Membership cards will be issued annually.

11.          Upon dissolution of the Marshall County Sportsmens Club, the club assets will be distributed to the members,  after all liabilities and debts are paid, in the following manner:  A  member to receive assets must be vested in the club for a minimum of five years and then the assets will be distributed to each member on a share basis based on the number of years having been a member.  Each year of membership will equal one share.                Added September 1, 2013.                                                                                                                                                                                                                                                                              

 

Article IV
Section 2
Duties of Members

1.     Every member, unless sixty-five (65)  years of age  and a ten year member, will have to work fifteen (15) hours per year, or serve 15 hours as a committee member of a Club function and committee chairman must sign off on number of hours each committee member put into the committee work.  If not, a one hundred eighty dollar ($180.00) assessment will be made at $12 per hour if no hours worked or for any fewer than 15 not worked. 2.     All members are to display the club stick in the lower right corner of the windshield of their vehicles.

3.     Upon entering or leaving the premises, member must lock the gate or a twenty dollar ($20.00) fine may be levied, unless a designated Club function is occurring.

4.     Members are to collectively authorize expenditures over one thousand dollars ($1000.00).

5.     Members are to adhere to all rules and by-laws of the Club.

 

Article V
Club Administration
Section 1
Officers
___________________

1.     The affairs of this Association shall be managed by the officers—President, Vice-President, Secretary, and Treasurer—and a Board of 5 Directors.

2.     Directors shall serve two (2) year terms.  Two Directors shall be elected on one year and three Directors shall be elected on alternate years.  All officers shall be elected for one (1) year terms

 

3.     The monthly meetings will be held on the first Sunday of the month at 2:00 p.m. and the election of Directors and Officers will be held the first Sunday of November or on a date set by the president.  Board meetings will be one hour prior to member meetings.   Amended 2012   Amended 5/4/2014

4.     Three (3) Directors of the Board of Directors shall constitute a quorum.

5.     This constitution and by-laws may be amended by a quorum of Directors and the members at the November member meeting and will go into effect on January 1st of the following year.      Amended     1/4/2015  Amended January 2016

6.     The Treasurer shall be allowed one hundred ($100.00) per month for reimbursed expenses.   Amended to $200per month           9/1/2013

 

Article VI
Section 2
Duties of the Officers and Board

1.     The President shall appoint all committees not otherwise provided for, subject to the approval of the Directors.

2.     The President or Directors may call a directors meeting whenever they deem it necessary.

3.     The Treasurer shall collect and receive all fines, dues, and money of the association, keep a regular account of the same, and pay all bills authorized by the Directors and members.                                              

4.     The Directors and Officers shall have general supervision of the property of the Association and shall authorize all necessary expenditures.  The President and Secretary shall sign conveyances and legal papers with the approval of the Board of Directors.

5.     Any violation of the rules and by-laws of this Association will be sufficient to cause the Board of Directors to order the suspension or forfeiture of membership rights and privileges. 

6.     Board members must attend at least 50 percent (50%) of the meetings.

7.     The Directors shall have the right to assess fees for the use of the grounds and building.

8.     It shall be the duty of the Directors to keep adequate grounds for recreation so far as the finances of the association will allow.

9.     The Officers and Directors shall maintain an eligibility list for prospective members.

10.   Upon the death of a Club member, the Club shall give twenty-five dollars ($25.00) to the family to be used as they wish.                                                                                                                                                  

 

RULES AND BY-LAWS

General Rules
_____________

1.     No shrubs, flowers, or other property shall be removed from the grounds.  No digging or destroying of property or water shall be allowed.

2.     Any property of the Association destroyed or injured shall be paid for, and members responsible may be suspended until full settlement is made.

3.     All garbage, papers, litter, etc. shall be gathered and put into garbage cans on the grounds.

4.     No livestock shall be allowed on the ground, except dogs on leashes, except by the action of the Board of Directors.

5.     The speed limit on the grounds shall not exceed 20 miles per hour.  Speed shall be reduced to 5 miles per hour around the Club house, campers, and lake area.       Amended January 2016

6.     Parents are accountable and responsible for the behavior of their children and guests.

7.     All vehicles shall travel on established roads and park in designated areas.

8.     Any member can be discharged from the grounds for disorderly conduct or disturbing the peace.

9.     No one will be allowed to climb trees, poles, tables, fences, etc. or deface property.

10.   ALL DOGS AND PETS ARE TO BE KEPT ON A LEASH AT ALL TIMES.  No dogs or other pets will be allowed in or around the Clubhouse or playground.

11.   No guns, rifles, pellet guns, BB gun, bows and arrows, sling shots, or weapons of any kind will be allowed.  Exceptions are:  Trap shooting or Club sponsored events and those persons issued permits by the Board to carry firearms.  Permits shall be renewed by the Board yearly.      Amended 2011  Amended 5/4/2014

12.   No fireworks on Club grounds.  Breaking of this rule by members or families or guests subjects the member to a fifty dollar ($50.00) fine or more, subject to the discretion of the Board of Directors.

13.   Tables and chairs are not to be loaned out.

14.   To rent the Clubhouse for a particular date, a rental contract must be signed and a one hundred dollar ($100.00) deposit given to the Treasurer.
A.    Rental fees shall be:
1.     Three hundred and fifty dollars ($350.00) for a function for a member or a Club member’s immediate family.
2.     Three hundred and fifty dollars ($350.00) for a non-profit organization if the Sportsmen’s Club operates the bar.
3.     Four hundred and fifty dollars ($450.00) for a function for an organization or someone outside the club members immediate family.
4.     The Wenona/Lostant Fire Departments may rent the Clubhouse for the fee of one hundred and fifty dollars ($150.00) and may sell liquor provided they purchase their own Dram Shop insurance and their own County Liquor license and state permit for the date rented.  These must be filed with the Treasurer ten (10) days before the rental date.
A.    The Fire Department renting the premises will be responsible for the cleaning-up after the event.
B.    Snow removal will be the responsibility of the Fire Department renting the building.

15.   There will be no bullfrog hunting.

16.   A copy of the rules and by-laws will be posted in the Clubhouse.

17.   The barrel key is for the lock on the refrigerator located in the member’s room or the main gate lock if the key card system is not working.  Should a member give this key to a minor or non-member, he/she shall be fined one hundred ($100.00) for the first offense.  In the event that a member violates this regulation a second time, his/her membership privileges shall be completely terminated forthwith, and in addition, he/she shall forfeit to the Club all membership fees and dues therefore paid by him/her to the Club, including refund thereof as provided in Article III, Membership Paragraph 9. (9-8-86). Barrel key also for padlock on gate when electric lock not working.

18.   The kitchen and main room of the Clubhouse will be off limits when the Clubhouse is rented.  Member room door to kitchen will be kept closed during any function.

19.   All members shall be responsible for leaving the restrooms, shelters, and grounds in an orderly condition.

20.   ATV’s will be allowed for work and designated club functions on club property by board approval. Driver must have a valid driver’s license. Amended September 21, 2009.

21.   Electric golf carts may be charged on club property for one dollar per charge. Money to be placed in red box in member’s room. Amended September 21, 2009.

22.   Golf carts are to be kept next to owner’s camper and can be left on club property when not present at club. Electric carts are not to be left hooked up to charger. Amended September 21, 2009.

23.   Number of committee members on all committee’s for work hours shall be approved by the board of director’s with names of committee members. Amended September 21, 2009
       24.  Kitchen area is for committee members only during a function and member room door should be kept closed at  
              all times.

By-Law
Section1
Guests

1.     Members entertaining guests on the Club ground shall, upon entering the grounds, register their guest’s names, and pay the guest fees at the place of registration designated by the Board of Directors.  The fees for guests shall be as follows:

Non-fishing guests – one dollar ($1.00) per day per person
Three dollars ($3.00) per day for a family of three or more

Fishing guests – three dollars ($3.00) per day for a family of three or more
Grandchildren sixteen years or older shall pay three dollars ($3.00) per day per person 

Shooting range guest fees will be the same as fishing guest fees

2.     Members will be personally responsible for the behavior of their guests.  No guests shall be admitted to the grounds unless the entertaining member or one his/her immediate family is on the grounds.  A guest shall not remain on the grounds after the departure of the entertaining member.  Guests cannot introduce other guests to the grounds.

3.     The same person may not be a fishing guest at the lake more than two (2) days per year.

4.     Any additional privileges must be obtained by written permission from the Board of Directors.

 

Section 2
Camping Rules
______________

1.     Camping with tents, trailers, etc., shall be done on Club property as approved by camping committee.

2.     Campers will be required to clean their area.

3.     Camping trailers with sinks, cooking facilities, and self-contained tanks for bathrooms must not be drained on the camping area.  A container should be placed under the drain whenever it is in use by the camper.                                                             

                                                                                                                                                                    

4.     Members must fill out a card for camping guests.  Fees for guest campers shall be twenty dollars ($20.00) per day, plus regular guest fees.  A guest camper may not camp more than five (5) consecutive days.   Member R.V. parking in the temporary parking spots in the campground limited to 14 days and must be moved 1 day from the spot used for the previous 14 days.   Cost for tent camping for guest shall be five dollars ($5.00) per day, plus regular guest fees.        Amended 1/05/2013

5.     For members, a fee of two dollars ($2.00) per day will be assessed for the use of electrical hookups, unless they are permanent campers.  Cost for tent camping for members shall be one dollar ($1.00) per day.   Amended 1/5/2013

6.     Campers must mow around their trailers.

7.     Campers owned by members may be parked permanently at the designated camping area.  The yearly fees for full hookup shall be as follows:

Two hundred and five dollars ($205.00) for campers without air conditioners      Amended 5/4/2014
Two hundred eighty dollars ($280.00) for campers with air conditioners

8.     All permanent campers shall pay their fees for permanent camping for camping by January 31st of each year.  If fees not paid by January 31st, the camper shall be removed from the camping area.    Amended 5/4/2014  Amended again January 2016

9.     Water hydrants must be shut off and hoses disconnected when the camper is not in use.

10.    Permanent trailer sites cannot be passed by member or spouse having site to family members, friends, or other members, etc.  When member or spouse gives up site, it will offered to the next member on the permanent waiting list for a site or member having site wishing to move.  Wishing to move site has first choice on available site.                              Amended/ added    1/5/2013  

11.  Camping on our premises is for recreational purposes only, such as weekend or short vacations.  no camping site is to be used for permanent or summer residence.  Stays longer than two weeks are subject to board approval.                                         Added September 1, 2013

12.  Anyone other than the registered permanent camper site holder with the club using that permanent site must pay the ordinary temporary camping fees and follow the temporary camping rules already written in the by-laws.                                           Added September 1, 2013       

 

Section 3
Lake Rules
__________

1.     No snowmobiles on the lake.

2.     Any member can claim shore space for one (1) boat, and must be responsible for cleaning up weeds and trash around it.

3.     Boats shall be registered with the Secretary of the Club and numbered with number given by secretary.

4.     No gasoline powered motors shall be allowed on boats at any time, with the exception of performing maintenance of the lake.

5.     Small electric motors are approved for use.

6.     All boats will be required to have a U.S. Coast Guard approved life preserver for every person in the boat.  (IL boating laws)

7.     Each boat owner shall be responsible for his boat in case it is damaged, sunk or stolen.  Building of individual docks is not permitted.  Boats will be docked or beached in designated areas only.

8.     Only pole and line fishing will be permitted at the lake, and then only two poles per person.  This would make any trout line, throw line, or jug fishing illegal.  Using a shad net for catching bait is legal.

9.     No digging of worms for fishing on the Club grounds.

10.   Children twelve and under must wear life preservers when in a boat.

11.   No dirt bikes or ATV’s are allowed on Club property.

12.   The Club is not liable for any accidents to persons or property resulting from the use of or riding of snowmobiles, dirt bikes, golf carts, and/or horses.  Any damages will be paid by the owner.

13.   Golf carts are permitted.  Member must show ownership, be a licensed driver or 21 years of age and show proof of insurance.  They also must be registered with the Secretary of the Club.  Electric carts must pay a fee of $1 per charge and place in red box.  Golf carts may be parked at camping site.

14.   Any fish removed from the lake shall be registered at the designated registration place.

 

15.   Daily fish limits per membership (includes guests) are as follows:                  

        The Board will set the daily fish limits and sizes recommended by the DNR  or fish biologists at their discretion and notify the membership of any changes.  Limits will be posted in the member room and on the road entrance to the clubhouse.      Amended 9/7/2014

 

16.   There will be a one hundred dollar ($100.00) fine for any fish limit violation.

 

 

 

Section 4
Swimming Rules
_______________

1.     Swimming shall be permitted in designated area only.

2.     No swimming shall be allowed within twenty-four (24) hours after the application of the chemical Aquatrol K.

3.     The following rules are to be strictly adhered to:

A.    Swim at your own risk
B.    Members are responsible for family and guests
C.    Guests must be registered by member prior to entering water
D.    No swimming outside of ropes
E.    No beach balls or Frisbees allowed
F.     No swimming after sunset
G.    No glass in swimming or beach area.

4.     Fees for swimming guests shall be the same as non-fishing guest fees.

 

 AMENDMENTS OR ADDITIONS TO THE CURRENT BY-LAWS
                                                                                                                                                                                  
The number of committee members on all committees for work hours shall be submitted by the chairman to the Board before the event for approval and should include the names of those committee members.            2007

A $25 assessment  will be added to all dues notices to members to help defray the cost of railroad property purchased.
The assessment will last for five (5) years and will expire in the year in the year 2010.              2005   deleted 1/4/2015

Amendment to General Rules #11                 2011
Not guns, rifles, pellet guns, BB guns, bow and arrows, sling shots, or weapons of any kind will be allowed.  Exceptions are:  Use of shooting range, Trap shooting, Club sponsored events, and those persons issued permits by the Board to carry firearms on the property.  Permits should be renewed yearly.

A.    Members using the shooting range are required to:
          
1.     Possess a valid FOID card
2.     Read and Sign a list of rule/liability waiver
3.     Pay a thirty dollar ($30.00) yearly fee
4.     Strictly adhere to range rules
               B.     Guns, rifles, pellet guns, BB guns, bow and arrows, sling shots, etc. must be stored so they are not 
accessible to unauthorized persons.  Examples:  trigger locks, locking cases, locked inside a vehicle, etc.

              C.      Firearms are not to be stored on club property when the owner is not present. (includes campers,                       
                                Clubhouse,  etc.)                                             

               D.     Fees for non-member shooters will be the same as non-member fishing guests.

Member R.V. parking on a temporary site is limited to 14 consecutive days and the R.V. must be removed from the premises for 5 days before using a site again.

Under Rules and By-laws General Rules #11.          Amended 5/4/2014

No guns, rifles, pellet guns, BB guns, bows and arrows, sling shots, or weapons of and kind will be allowed.  Exceptions are:  Trap shooting, fire arms range (with annual club issued range card), archery range, Club sponsored events, and those persons issued permits by the Board to carry firearms.  Members who have been issued a club range card may keep weapons for range use secured in their vehicle, RV, or camper.  Members who have been issued a conceal/carry license by the State of Illinois may, by written request to the Board, be permitted to conceal/carry while on the grounds.  The Board may disapprove any request for any reason.  Those approved must be in compliance with all State and Federal Laws at all times.  A confidential list of those persons will be kept by the Secretary.  Guests and visitors with conceal/carry license will be restricted while on the MCSC property.  Active and off duty law enforcement officers are not subject to these restrictions.  Permits shall be reviewed by the Board annually.
